Terms of use
This document regulates the access and use of mobile applications or websites of MentalWorld.pl, as well as the use of the brokerage service (hereinafter referred to as: "Regulations"). Please read carefully and express? consent to these Regulations before accessing and using the MentalWorld.pl mobile applications or websites. From moments? By agreeing to these Regulations, a contractual relationship arises between the User and MentalWorld.pl. 6. user? entity to obtain access to the services provided by MentalWorld.pl as part of Mental World, on the terms set out in the Regulations.

8. Buyers? A User taking steps to acquire or purchasing Services as part of Mental World.

MentalWorld.pl services
1. Services provided by MentalWorld.pl consist of you? With:
a. access to mobile applications or websites of MentalWorld.pl and use them to order and perform Services provided by Sellers or Services provided by MentalWorld.pl,
b. collecting and processing payments (including issuing invoices and bills on behalf of the Sellers), consisting in enabling MentalWorld.pl to collect and charge fees from the Buyers' bank account and transfer the accrued ? funds to the bank account of the Sellers for their Services or to the account of MentalWorld.pl for the Services provided by MentalWorld.pl. MentalWorld.pl may engage affiliates, third parties, payment service operators to provide these services on their behalf,
c. intermediary service consisting in enabling Buyers to order and use the Seller's Services or Services provided by MentalWorld.pl,
d. enabling Buyers to conclude contracts with Sellers or to pay for the service.
§3
Conditions of Participation in Mental World
1. Users can would? natural persons who are over 18 years of age and have full ability?? to legal transactions, legal persons and organizational units without legal personality, but able to purchase in their own name rights and enlist? obligations.
2. The use of making purchases of Services provided by MentalWorld.pl and Mental World's functionalities in this respect, with the exception of selling Services, is possible after registering and completing the appropriate form.
3. 5. 11. The user should keep up-to-date data in the settings after logging into the Account.
12. The User gains access to the Mental World Account (login) after providing:

Login to Mental World via Automated Solutions Service and through external authentication services (e.g. offered as part of other websites cooperating with MentalWorld.pl, including those of a social nature), causes the same effects as logging in directly on the Mental World website.
13. The user is not allowed to use from the Accounts of other Users and share the Account to other persons, except for making the Account available to persons duly authorized by the User to act on his behalf.
14. In a situation where the Account or activity of the User within Mental World requires additional verification of the data referred to in par. 3, or in the event that MentalWorld.pl has reasonable concerns as to the security of the Account or Transaction, in particular regarding unauthorized takeover of the Account by another person, or in the event of a breach of the Regulations by the User, MentalWorld.pl may:
a. addictive the use of Mental World or individual services provided as part of Mental World after the User confirms his credibility with appropriate documents, including identity,
b. time limit? access to individual services provided as part of Mental World,
c. suspend? for a definite or indefinite period User Account,
d. apply mechanisms or tools that block the operation of bots or other IT or programming tools.

15. Within 14 days of concluding the agreement referred to in par. 6, The User who is a consumer pursuant to art. 22 [1] of the Civil Code or a User who is a physical containing contract directly related to from her activities economic, when the content of this contract shows that it does not have a professional nature for this person, resulting in particular from the subject of the work performed by him/her economic activity, made available on the basis of the provisions on the Central Register and Information on Economic Activity, may withdraw from it without giving reasons. 16. MentalWorld.pl uses mechanisms whose purpose is to ensure an appropriate level of security for Transactions and other services provided as part of Mental World that the User uses.
17. Execution of Transactions and other services is possible only if they are provided with an appropriate level of security.
§4
Transactions
1. Under Mental World, the Seller defines the terms of the Offer and makes them available to Buyers.
2. The offers referred to in this paragraph may would? presented by entities cooperating with MentalWorld.pl on the basis of separate agreements, in particular as part of websites or Internet applications (including mobile applications) run by them.
3. Sellers undertake you? not to offer Services, the trading of which violates applicable law or rights of third parties (in particular copyrights and other intellectual property rights), as well as whose issue may be considered as violating good manners. It is forbidden to publish and present any content that violates commonly accepted ethical or moral or customary standards, in particular those that incite or promote hatred, violence or any form of discrimination, including those based on nationality, skin color, beliefs , religion, worldview, orientation? sexuality, promoting authoritarian and totalitarian systems, as well as any content that praises or supports such behavior.
4. The Seller prepares the Offer by filling in the sales form available within Mental World, thus specifying the total terms of the Transaction. At the moment of entering information or data into the content of the Offer, MentalWorld.pl acquires the right to use them, in particular to use them in any way, at any time, at its sole discretion. By placing information or data in the content of the Offer, the Seller declares that he is entitled to introduce them to the content of the Offer, and that they will be used within Mental World and by MentalWorld.pl ? in particular in the manner specified in the preceding sentence ? does not infringe the rights of third parties. 8. From the moment the Offer is published, the Seller is bound by its content. User from the moment introducing to the Offer (publication in Mental World) content that is subject to copyright protection, in particular signs, logos, image, description and photos (?Content), allows MentalWorld.pl to use this Content free of charge, non-exclusive, unlimited in time and territory in the following scope:
a. saving and multiplying with all techniques, including recording and copying on all kinds of paper, electronic, magnetic media, or optical;
b. dissemination via telecommunications networks (including the Internet) in any way and using any technology, in particular by: dissemination in such a way that everyone can have access to the Content at a place and time of their choice and other methods of exploitation in telecommunications networks, regardless of the possible methods of limiting access; public display and reproduction, including through the mechanisms of automatic content playback on websites;
c. public performance, exhibition, display, reproduction, broadcasting and re-broadcasting;
d. lending and marketing.
The User's consent also includes the creation of Content by MentalWorld.pl and the use of these elaborations to the extent that MentalWorld.pl is entitled to use the Content and to grant further consents to the extent corresponding to the consent granted to MentalWorld.pl.
The user agrees for the exercise of moral rights to the Content by MentalWorld.pl and declares that it will not exercise these rights in relation to MentalWorld.pl and entities to which MentalWorld.pl will grant further consents to use the Content.

The User shall release MentalWorld.pl and entities to which MentalWorld.pl grants further consent to use the Content, from any liability resulting from the use of the Content in accordance with the Regulations.
9. In order to create a description of the Offer, the Seller fills in the form available on the relevant Mental World website, in which, in particular, title? 12. In the event of withdrawal from the contract by the Buyer, when the Service has not yet been performed, the Seller undertakes to will make refund of funds paid by the Buyers for the purchased Services, within 7 business days, counting from the date of cancellation of the Transaction by the Buyer.
13. In the case referred to in par. 12, the commission due to MentalWorld, referred to in §5 sec. 1 will be returned to the Seller in the amount of half of the commission paid. The commission due to the payment service operator is not refundable, unless otherwise agreed between the Seller and that operator.
14. In the event of a complaint about the Service purchased by the Buyer, the Seller undertakes to consider? complaint within 14 calendar days from the receipt of the complaint and if it is accepted, make appropriate action or make immediately return the funds paid by the Buyers for the purchased service.
15. The seller can order payment service operator, on the basis of information provided by MentalWorld.pl, temporary suspension of the withdrawal of funds or payment funds recorded as part of the settlement tool maintained for the Seller, in order to return the amounts paid by the Buyers for the purchased Goods.
16. In the cases referred to in par. 12 and 13 above, the Seller undertakes to will make full refund of funds paid by Buyers for purchased Services.
17. Mental World isn't partying? any agreements (including the sale or provision of Services) concluded between Users and does not guarantee that the Seller and the Buyer are entitled to conclude and perform the contract.
18. The buyer concludes a contract with the Seller, confirming the purchase using button ?Book now? or any other similar meaning.
19. Confirmation of the conclusion of the contract between the Buyer and the Seller is sent automatically by e-mail. e-mail (or optionally via other means of electronic communication, including using a mobile application) and is for information purposes only. 21. MentalWorld.pl is not responsible for Users' behavior within Mental World or for improper performance or their failure to perform the agreements concluded as part of the Transaction, as well as for the consequences of actions taken by Users and third parties, and constituting a violation of the provisions of of the Regulations. 1. failure to pay the amount due to MentalWorld.pl by the User within the prescribed period,
2. providing incomplete or false contact details by the User in the Account settings (e.g. name and surname, company, address),
3. making the Account available by the User to other people contrary to the rules set out in the Regulations,
4. taking action aimed at avoiding payments in connection with fees or commissions charged by MentalWorld.pl.
26. MentalWorld.pl may temporarily limit The user's access to individual services provided as part of Mental World, in particular to limit for a definite or indefinite period functionality User Accounts or suspend for a definite or indefinite period of time the account of this User.
27. MentalWorld.pl will notify the User about suspension of the Account or limitation of access to specific services via e-mail, indicating the reasons for suspension or limitation of access to the Account. 28. The user bears the full responsibility?? for his actions and omissions related to the use of Mental World, in particular, he may incur responsibility?? compensation towards MentalWorld.pl or other Users.
29. In the case of providing MentalWorld.pl with the avatars referred to in §3 sec. 9 of the Regulations, the User declares that he is entitled to use this avatar within the framework of the Regulations, and the use of it within Mental World and by MentalWorld.pl does not infringe the rights of third parties. The user is responsible for truthfulness the statement referred to in the preceding sentence and will release MentalWorld.pl from any liability related to the use of the avatar in Mental World that is unlawful or infringes the rights of third parties.
30. The User whose Account has been suspended or on whom functional limitations have been imposed, referred to in par. 24, can not both register? new and how to use? from another Account without the prior consent of MentalWorld.pl. The payment service operator, acting on behalf of MentalWorld.pl and on the basis of information provided by MentalWorld.pl, is entitled to temporarily suspend the payment of funds to the Sellers.
31. MentalWorld.pl has access to the following categories of User's data: data about the Offer, in particular including the content of Offers; data identifying the Buyer as part of the Transaction; Transaction data - in particular the payment method, service delivery address, delivery method, additional comments, and may also have access to the content of messages sent between the Buyer and the Seller, however, in the latter case only when MentalWorld.pl has reasonable grounds to and objectively verifiable concerns? as to the unlawful activity of the User. 32. The user does not have access to all data that is available for MentalWorld.pl. The user has free access to data on activities performed by him within Mental World, in particular: ordered services, performed services and canceled services, as well as information exchanged between Users regarding the implementation of these services using Mental World functionality.
§5
Fees and commissions
1. Services provided by MentalWorld.pl as part of Mental World are paid. All fees and commissions are charged to the Seller. These charges are calculated and collected on an ongoing basis for each transaction, on which a commission is charged in the total amount of 17.0%, for which consists of commission for Mental World and commission for payment services operator.
2. are not allowed User's actions, the purpose or effect of which is to avoid payments in connection with fees or commissions charged by MentalWorld.pl.
3. For services provided under Mental World, MentalWorld.pl issues invoices in accordance with the data contained in the Account settings, at the Seller's request.
§6
Final provisions
1. All activities undertaken by the User within Mental World should be in accordance with the Regulations, decency and applicable law, including those relating to the protection of consumer rights. The user cannot take works contrary to the Regulations, decency and applicable law, as well as activities that have a negative impact on on the safety of the functioning of Mental World or harm? users.
2. The User is obliged to explain the correctness of the contract concluded between the Buyer and the Seller. The seller is obliged to provide answers and provide exhaustive explanations.
3. Users should archive their own information on contracts concluded under Mental World.
4. All materials, including graphic elements, arrangement and composition of these elements (so-called layout), trademarks and other information available on the Mental World websites constitute the subject of the rights of MentalWorld.pl or Users. The items listed may constitutes? subject of proprietary copyrights, industrial property rights, including trademark registration rights and database rights, and as such enjoy from statutory legal protection.
5. Downloading or using in any scope of materials available within Mental World (including data and other information) each time requires the consent of MentalWorld.pl and may not violate the law. will I decide? of the Regulations and generally applicable law, as well as can't infringe interests of MentalWorld.pl and Users.
6. It is forbidden:
a. the use by third parties of markings to which MentalWorld.pl is entitled, including characteristic graphic elements, in particular such as: logos, photos, descriptions or other types of markings,
b. aggregation and processing of data and other information available in Mental World for their further use as part of their activities (including the activities of other websites), as well as their further sharing within other online services and outside the network? Internet.
7. MentalWorld.pl provides Users with information, including information on successful payment made using the payment methods available in Mental World, as well as information on purchased, completed or canceled Services within the Mental World, through automatic communication channels, i.e. channels enabling contact with with Users via e-mail, notifications placed as part of the User Account in connection with the conclusion of Transactions, push messages as part of the mobile application and statuses available in the ?My activity tabs ???.
8. MentalWorld.pl can provide Users other services that support the main activities MentalWorld.pl or facilitating the use of MentalWorld.pl services by Users, including financing, securing or advertising Transactions, on the terms set out in the regulations of such services, as well as consisting in MentalWorld.pl in concluding contracts for third party services.
§7
privacy??
1. Personal data provided by Users in places intended for this purpose is processed by MentalWorld.pl in accordance with applicable law and in accordance with the privacy policy. privacy in Appendix No. 2 to the Regulations.

4. It is forbidden to use the information referred to in par. 3, for commercial purposes consisting in promoting the User's activity outside Mental World in any form. In particular, it is forbidden to:
a) submitting a proposal to purchase or sell the Service outside Mental World,
b) attaching to the Offer or providing in any other form content containing information about commercial activities conducted outside of Mental World (for example, leaflets advertising a private practice).
§8
Amendments to the regulations
1. MentalWorld.pl is entitled to change the Regulations in the following cases:
a. changes in the law having a direct impact on the content of of the Regulations;
b. the imposition of specific obligations by state authorities;
c. price changes;
d. improving the operation of the Website and User service;
e. improving the protection of Users' privacy;
f. changes to the privacy policy;
g. fraud prevention;
h. security considerations;
i. technological and functional changes;
j. changes in the scope of services provided, including the introduction of new ones;
k. editorial changes.
2. This change becomes effective within the period indicated by MentalWorld.pl, not shorter than 15 days from the moment of notifying the Users of the changes and making the amended Regulations available to them, in particular through its publication. on the website https://mentalworld.pl/ and sending it to the e-mail address assigned to the Account of a given User.
3. MentalWorld.pl may introduce changes? of the Regulations without observing the 15-day period referred to above, including with immediate effect, in the event that:
a. is subject to a legal or regulatory obligation, based on which it is obliged to amend the Regulations in a way that prevents it from complying with the above-mentioned 15-day notification period,
b. must, by way of exception, change Regulations to counteract unforeseen and imminent security threat intermediation services, Users against fraud, malware, spam, data breaches or other cybersecurity threats.
§9
Termination of the contract with MentalWorld.pl
1. The provision of services under Mental World is indefinite, subject to the provisions of included below.
2. The user may at any time express contract contained? from MentalWorld.pl, regarding account indicated by him, by submitting a notice of termination of the contract. In this case, all previously published Seller's Offers will be removed within 7 days from the date of submitting the termination notice.
3. Termination by the User of the agreement with MentalWorld.pl, regarding the Account indicated by him, takes effect no later than 60 days from the date of termination of the agreement (understood as the day of submitting the termination of the agreement). After the indicated period, logging in to the Account and the use of services available in Mental World as part of the Account will not be possible.
4. In the event of repeated violations of the Regulations by the User, the contract may be terminated. terminated by MentalWorld.pl upon notice, with a thirty-day notice period.
§10
Contact and complaint procedure

c. by telephone to the telephone number indicated by the User,
d. short SMS text messages to the telephone number indicated by the User,
e. automatic communication channels, i.e. in the form of notifications placed as part of the User Account in connection with the conclusion of the Transaction, push messages as part of the mobile application and statuses available in the "My activity" tabs.
3. In the event that, in the opinion of the User, the services provided on the basis of the Regulations are not implemented by MentalWorld.pl or implemented contrary to the provisions of the Regulations, he may submit reservations in the manner specified below (Complaint). At the same time, in the case of own sale of Services conducted by MentalWorld.pl, the User may report complaint? in the manner described in the content below.

5. MentalWorld.pl recognizes the Complaint? within 14 days from the date of its receipt.
